| Kentucky Educational Rights Center, Inc. | |
|---|---|
| Tel:(859) 983-9222 Midway, KY 40347 |
The Kentucky Education Rights Center was established to work with families of children (ages 3 years to 21 years) with physical and mental disabilities in their relations to the public school systems. The children's medical condition(s) trigger certain protected rights under both the Individuals with Disabilities Education Act of 2004 (IDEA), the Rehabilitation Act of 1973, (Section 504), and the Special Education Laws of the Commonwealth of Kentucky. Both of the former federal Acts, as well as Kentucky law recognize and require that qualified children with disabilities be provided services and/or accommodations in the pursuit of their education. Our experience over the past many years has revealed that many of these families are not familiar with these laws affecting their children's entitlement. Others are or have been intimidated by the process necessary to obtain these entitlements. By and large the school districts make limited resources available to these families, often as a result of their own lack of understanding concerning the disabilities, or the district's perceived lack of financial resources.
